Terms of Service

These terms cover your use of Streamless. The plain-language summary: buy it once, use it on your Mac for your own music, back up your devices because syncing writes to them, and understand the app is provided as-is. The full terms below control.

1Agreement

These Terms of Service ("Terms") are an agreement between you and Sodium Studio, LLC ("Sodium Studio," "we," "us") governing your use of the Streamless application ("Streamless," the "app") and the streamless.app website. By downloading, installing, or using Streamless, you agree to these Terms. If you do not agree, do not use the app.

2License

When you purchase Streamless, we grant you a personal, non-exclusive, non-transferable license to install and use the app on Mac computers you own or control, for your own personal use. This license is for the use of the software; you do not own the software itself, and all rights not expressly granted are reserved by Sodium Studio.

You may not resell, redistribute, sublicense, rent, or share your license or the app; remove or alter any proprietary notices; or attempt to circumvent the app's licensing or trial mechanisms.

3Free trial

Streamless offers a free trial period of fourteen (14) days so you can evaluate the app before buying. During the trial you have access to the app's functionality. When the trial ends, certain features become unavailable until you purchase a license, while music you have already added to your library remains accessible.

CUSTOMIZE: Confirm this matches your final trial behavior (soft feature-gate: library/playback stay available, ripping/import/sync require purchase after day 14).

4Purchases, pricing, and refunds

Streamless is sold for a one-time price through Paddle.com, which acts as our authorized reseller and merchant of record. Your purchase is also subject to Paddle's buyer terms. Prices are shown at the point of sale and may change over time; changes do not affect licenses already purchased.

Because we offer a free trial that lets you fully evaluate Streamless before paying, we encourage you to use it. If you experience a problem with your purchase, contact us and we will work with you in good faith; refunds are handled through Paddle in accordance with its refund policy and applicable consumer law.

CUSTOMIZE: Set your actual refund stance (e.g. "30-day refund, no questions asked" vs. "refunds at our discretion given the free trial"). Whatever you choose must be consistent with Paddle's policies and the consumer-protection laws of the markets you sell in.

5Your music and your responsibilities

Streamless is a tool for managing music you are entitled to use. You are solely responsible for ensuring that you have the legal right to rip, import, copy, and transfer any audio you use with the app, and for complying with all applicable copyright and other laws in your jurisdiction. Sodium Studio does not provide music and is not responsible for how you use the app with respect to content you do not own or have rights to.

6Devices, backups, and data loss

Streamless writes data to iPods and other devices you connect in order to sync your music. Working with older hardware and existing device libraries carries inherent risk. You are responsible for maintaining your own backups of your music, your devices, and any data you value. To the fullest extent permitted by law, Sodium Studio is not liable for any loss of or damage to data, libraries, files, or devices arising from your use of the app.

7No affiliation with Apple

iPod, iTunes, Mac, macOS, and Apple Music are trademarks of Apple Inc. Streamless and Sodium Studio are not affiliated with, authorized by, endorsed by, or sponsored by Apple Inc. References to Apple products describe compatibility only.

8"As is" — no warranty

Streamless is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or every version of macOS, or that it will meet your requirements.

9Limitation of liability

To the fullest extent permitted by law, Sodium Studio will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of or inability to use Streamless. To the extent any liability cannot be excluded, our total liability to you for any claim relating to the app will not exceed the amount you paid for it.

10Updates and changes

We may release updates that add, change, or remove features, and we may discontinue the app. Free updates within the current major version are included with your purchase; significant new major versions may be offered as separate paid upgrades.

11Termination

This license continues until terminated. It will terminate automatically if you breach these Terms. On termination you must stop using and delete the app. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.

12Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules, except where overridden by mandatory consumer-protection laws of your place of residence.

CUSTOMIZE: Confirm Massachusetts is the governing law you want. This is one of the clauses most worth a lawyer's quick look if you sell internationally.

13Changes to these Terms

We may update these Terms from time to time. When we do, we'll revise the "last updated" date above. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.
